Correction to Information on Section of International Law Task Force

WASHINGTON, D.C., Feb. 22, 2011–The _ has taken no action in support of, or in opposition to, judges considering Islamic law or Sharia.

The _ has nearly 400,000 members, many of whom volunteer with any of the ABA’s 2,200 entities.  One of those 2,200 entities is the Section on International Law, which has elected to assemble a taskforce of several individuals to examine this issue.

These individuals are examining whether the proposed changes to the law impact important constitutional questions.  They are also considering implications for international commerce.

The actions of a few interested members within one section are not and cannot be interpreted to be those of the entire _. Claims to the contrary are erroneous.

    It doesn’t take a lawyer to see that Sharia and the U.S. Constitution are incompatible. Time for you to grow a pair and pick one or the other.

    Islamic law is not international law.
    You are trying to treat it as if it were arrived at via tribunal and rational process.
    Sharia does not represent the rule of reason, it is Islamic tradition that happens to have been practiced transnationally by way of conquest, domination, and oppression.
    Sharia is not reason.
    And any law code that is not based on reason should have no standing in a Western country.
    If you wish to repudiate the Western identity you have, and the Western history out of which American law comes, be my guest.
    Just remember that you will lose my respect in the process.

    if 2200 entities are operating under the umbrella of of the ABA. the ABA is responsible for their action. It is like a father having 12 or more children and telling that he cannot control all of them.
    I would like to find the list of the members of this international task force. Being affiliated with the French and Swiss bar , I have never heard of such a task force. Maybe it is another trick of the OBama admnistration in order to shred just a little bit more the US constitution .
    People are watching and getting educated. The _ should take a stand and uphold the Constitution .

    I have a great idea for the ABA! Let’s support the introduction of Sharia law in the US. It sounds like such a tolerant and multiculturally friendly thing to do. To be opposed would be such a nasty and unfriendly thing; Muslims would be so hurt and humiliated!

    After all, what could be wrong with supporting (as opposed to the only other choice, opposing) the introduction of an explicitly sectarian (Koran) dependent, 8th Century system of tribal law into the United States, requiring a complete restructuring of our society? (You know, those core concepts of free will, freedom of choice, rationality, freedom of conscience, respect for the individual, non-sectarianism, the Constitution even, and on and on). Oooops!

    And, there may be some benefits. Let’s look at the societies where Sharia is most rigidly practiced: Saudi Arabia, Iran, Pakistan, Bangladesh, for example. Oooops!

    Of course, some in the ABA may approve of standard Sharia concepts/practices, such as: subordination of woman’s equality in almost all application of Sharia law (both civil and criminal) and organization of civil society. Yes, Virginia, woman under Sharia are subject to stoning for adultery, or execution for being raped; the worth and validity of their testimony in Court is not equal to that of a man; they are not allowed equal rights to inheret; abortion is forbidden. Their lives in Sharia in all aspects are generally closely supervised by men… Well, really, the list goes on and on, but you get the idea… Oooops!

    The ABA appears to have lost its collective mind to even tolerate the existence of this International Law study group. That it has not been immediately denounced by the ABA’s governing body is an insult to all of us. You have abandoned your right to speak for a civil society, based on the rule of law. Your Association has been infiltrated by Islamists. It is shameful to even contemplate (”study”) the application of Sharia law in the United States. Disband and denounce this group at once!

    Time for ABA to uphold and respect the Constitution. Pandering to sharia only serves to hasten the poisoning of our country and should be rejected outright. Reject this assault on our Constitution.

    If the heads of the ABA weren’t in-concert with the endeavors of a fraction of their organization, they would publically denouce, while ‘Barring’ those people that are fishing to help these enemies of this nation to install Shariah.

    I am a member of the ABA, and I am deeply troubled by this encroachment of Sharia law. Under the existing laws of our country, Muslims are free to worship Allah. Freedom of religion should be all that we need to guaranty.

    It is interesting to note that this Task Force does not appear to have any link on the ABA website. Where is the transparency? Are there reports issued? Meetings held? How does anyone express a contrary opinion?

    Are you totally unaware that we have a Constitution in the United States?? Apparently not. Do the world a favor and read it. It’s quite enlightening. And NOWHERE in that Constitution is a place for sharia law in any shape, fashion or form. Of course if you don’t believe me, just read it. Your position is abhorrent.

    Hey, if the ABA is taking it upon themselves to “…take no action…in opposition to judges considering Islamic law…”, maybe you Legal Eagles can look into other legal systems for our US judges to consider. How about Napoleonic Law? Maybe Vatican Law? I know: Judges should consider Monarchy laws! Yeah, that’s the ticket.

    Boy, those guys at the ABA sure are hilarious! Oh, wait…The ABA was actually being serious?!?!?! Uh Oh.

    It would be better if ABA launches a task force to investigate the encroachment of sharia which is a completely alien system of laws that are incompatible with our Constitution.

    When the Atlantic Charter was created, we adopted it as we would any other treaty.
    If Muslims want Sharia to have standing in this country, then they had better negotiate a treaty with our government and get ratification for it in the Senate.
    Only then might Sharia be treated as international law and adopted as part of our law.
    I’ll say it again though– Sharia is not, in fact, international law, but ISLAMIC tradition.
    Why is it that the ABA cannot distinguish the obvious differences between medieval tradition and international law?
    In the West the law = reason.
    In Islam, Sharia = an anti-humanistic god.
    A god and prophet that non-Muslims believe to be false.
    Will you really impose such a system of law here?

    The idea that the ABA would do such a treasonous thing as to support Sharia law over the Constitution sounded so alarming that I did some fact-checking to make sure it was true. Here’s what I found:

    There, Geller ‘quotes’ the ABA’s International Policies document as saying “The Section’s Executive Counsel has organized a Task Force to review the legislation of 14 states … in which anti-Sharia legislation has been introduced. The goal of the Task Force is to have a Report and Recommendation against such legislation as well as an informal set of “talking points” that local opponents of these initiatives could use to make their case…”

    THE PROBLEM IS: The actual ABA International Policies document she links to DOES NOT EVEN MENTION SHARIA LAW or any part of her so-called-quote. IT’S ALL BUNK.

    Don’t believe me? Then pull up the pdf yourself and ctrl+F for “Sharia” and you’ll find zip. Nothing in her ‘quote’ is in there. At all.     The only mention of Islam in the document is critical of Iran’s human rights abuses, and is thus, if anything, ANTI-Sharia. Really classy of Geller to unfairly attack the ABA over nothing. Some conservatives will say anything to make trial lawyers look like the devil. But let’s keep fixed on actual truth, and put Pamela Geller on our list of untrustworthy sources.

    When American lawyers lose their ability to reason, they should just retire and let the rest of the population enjoy the laws and freedoms already established here. This is still America and not the middle east. You are not elected officials representing the will of the people. Get over yourselves! Do the right!!!

    On the ABA web page you have a note about remembering veterans on Memorial Day. Maybe you should remember the veterans, and those still serving who are trying to keep America free from those who would impose Sharia Law on us, kill us all and shred the Contitution. Until you either reign in your members, or defect to Sharia as an entity, you need to take the remarks off your web page. As a veteran I find it insulting that you, and your members are speaking out of both sides of your mouth to appease.
